3. Our Products

Celesto designs and sells fashion, apparel, accessories, fragrances and related products.

Product photographs, videos, colours and visual representations are intended to provide an accurate representation of our products. Minor variations may occur as a result of screen settings, lighting, manufacturing processes, natural materials, hand finishing or production tolerances.

Products made from leather, suede, silk, natural fibres, stone, crystal, embroidery, washed fabrics, printed fabrics or other natural or handcrafted materials may show individual variations. Such characteristics do not necessarily constitute defects.

Product descriptions, measurements, materials and other specifications are provided as accurately as reasonably possible.

4. Availability

All orders are subject to availability.

Placing a product in your shopping bag does not reserve that product.

If an item becomes unavailable after an order has been placed, we may cancel the afected item or order and refund the relevant amount.’

We may impose reasonable purchase limits or refuse orders where we reasonably believe that products are being purchased for unauthorised resale, fraudulent purposes 3 of 30 or in quantities inconsistent with normal consumer use.

5. Orders and Formation of the Contract

After you place an order, you will normally receive an electronic order confirmation.

An automated acknowledgement of your order does not necessarily mean that we have accepted the order.

The agreement between you and Celesto B.V. becomes final when we accept the order, for example by confirming acceptance, preparing the order for fulfilment or dispatching the products.

We reserve the right to refuse or cancel an order before acceptance where, for example:
a product is unavailable;

  • payment cannot be authorised;
  • there is an obvious pricing or product-description error;
  • we reasonably suspect fraud or misuse;
  • delivery to the requested destination is not permitted or possible;
  • fragrance shipping restrictions apply;
  • the order breaches these Terms or applicable law.

If we cancel an order after receiving payment, the relevant amount will be refunded.

6. Prices

Prices displayed on the Website are shown in the currency selected or displayed at checkout.

Where applicable, prices include VAT as required by law.

Shipping costs, if any, are shown separately before you complete your order.

For deliveries outside the European Union, additional import duties, local taxes, customs charges or handling fees may become payable by the recipient. These are not included in our product or shipping prices unless expressly stated otherwise.

Obvious pricing errors do not bind Celesto. If we discover an obvious error before accepting an order, we may contact you and ofer the opportunity to purchase the product at the correct price or cancel the order.

7. Payment

You may pay using the payment methods made available at checkout.
Available payment methods may change from time to time.

Payment processing may be performed by specialised third-party payment providers. Celesto does not necessarily receive or store complete payment-card information.

Orders may be subject to fraud-prevention and security checks.

If payment is refused, reversed or otherwise unsuccessful, we may suspend or cancel the order.

8. Shipping

Celesto ships apparel and accessories worldwide, subject to carrier availability, legal restrictions and the shipping destinations available during checkout.

Fragrances are currently shipped only within the European Union and the United Kingdom.

Shipping fees and free-shipping thresholds are described in our Shipping & Returns Policy and shown during checkout.

For destinations outside the European Union, shipments are generally made on a Delivered at Place (DAP) basis unless expressly stated otherwise.

This means that the recipient is responsible for applicable import duties, local taxes, customs charges and clearance fees.

You are responsible for providing a complete and accurate shipping address and contact information

9. Delivery

Any delivery dates or periods shown on the Website are estimates unless we expressly agree that a specific delivery date is guaranteed.

We aim to dispatch and deliver orders without unreasonable delay.

Delivery times may be afected by circumstances outside our reasonable control, including carrier disruption, customs procedures, severe weather, strikes, force majeure, security checks or events afecting international transport.

If a legally applicable delivery period is exceeded, your statutory consumer rights remain unafected.

Risk in the products passes to you when the products are delivered to you or to a third party designated by you, except where you independently instruct a carrier that was not ofered by Celesto

10. Duties and Customs

International shipments may be inspected or delayed by customs authorities.

For shipments outside the European Union made under DAP terms, the customer or recipient is responsible for paying all applicable import duties, local VAT or sales taxes, customs charges and clearance fees.

Failure to pay such charges may cause the shipment to be delayed, returned, abandoned or destroyed.

Where a shipment is returned to Celesto because the customer refused or failed to pay applicable import charges, we may deduct reasonable costs actually incurred as a result, to the extent permitted by law.

11. Right of Withdrawal

Consumers who are entitled to a statutory right of withdrawal may withdraw from an online purchase within 14 days after receiving the goods, without providing a reason.

Where an order consists of multiple goods delivered separately, the withdrawal period begins when the final relevant item is received, where required by applicable law.

You may exercise your right of withdrawal through our online return process, by contacting info@celesto.global, or through the online withdrawal function made available on the Website.

After notifying us of your withdrawal, you must return the relevant products within the legally applicable return period.

Further details are contained in our Shipping & Returns Policy.

12. Return Costs

Unless otherwise required by law, customers are initially responsible for the direct cost of returning products when exercising the right of withdrawal.

Celesto may reimburse some or all return costs for certain destinations or return methods.

Where return shipping reimbursement is available, this will be indicated in the applicable return process or Returnless return portal.

A reimbursement of return costs ofered in one country, region or situation does not automatically create an entitlement to reimbursement in other countries or circumstances.

If we supplied an incorrect, defective or materially misdescribed product, Celesto will bear reasonable return costs where required by law.

13. Condition of Returned Products

You may inspect a product to the extent reasonably necessary to establish its nature, characteristics and functioning, in a similar way to how you could inspect it in a physical store.

You are responsible for any reduction in value caused by handling beyond what is reasonably necessary for that purpose.

Returned products should therefore, where reasonably possible, be returned:

  • clean and unworn;
  • with original labels and tags attached;
  • with their original accessories;
  • in their original protective packaging;
  • without damage, stains, odours, alterations or signs of excessive use.

The absence of original packaging does not automatically remove statutory consumer rights, but may be relevant when assessing any actual reduction in value.

14. Fragrance Returns

If you intend to exercise your right of withdrawal for a fragrance product, we recommend that you do not unnecessarily open, spray or use the product.

Where fragrance has been opened or used beyond what is reasonably necessary to inspect it, Celesto may make a lawful deduction for any resulting reduction in value.

Where a particular product is supplied sealed and qualifies under applicable law as a sealed product that is not suitable for return for health-protection or hygiene reasons once unsealed, the right of withdrawal may cease when that seal is broken.

We will apply such an exception only where permitted by applicable law.

15. Personalised and Custom Products

The statutory right of withdrawal may not apply to products that are made to your specifications or clearly personalised for you.

Where applicable, this will be communicated before purchase.

Your statutory rights in relation to defective or non-conforming customised products remain unafected.

16. Refunds

Where you validly exercise a statutory right of withdrawal, refunds will be made in accordance with applicable consumer law.

Unless otherwise required by law, we may withhold reimbursement until we have received the returned products or you provide suficient evidence that you have sent them back, whichever occurs first.

Refunds are normally made using the same payment method used for the original purchase unless another method is expressly agreed.

For a full withdrawal from an order, we will refund the standard outbound delivery cost where required by law.

If you selected a more expensive delivery method than our standard option, the additional cost of that premium delivery method does not have to be refunded.

17. Faulty or Incorrect Products

Celesto has a legal obligation to supply products that conform to the agreement.

If you receive a defective, damaged, incorrect, or materially different item, please contact us as soon as possible at info@celesto.global

Depending on the circumstances and your applicable legal rights, we may repair, replace, refund or otherwise provide an appropriate remedy.

Nothing in these Terms restricts statutory consumer guarantees or conformity rights.

18. Pre-orders and Products with Future Delivery

Where we offer products on a pre-order or future-delivery basis, the estimated availability or shipping period will be indicated on the relevant product page or during checkout.

Estimated dates may change due to production, transportation, quality-control or other circumstances.

Where a material delay occurs, we will provide information where reasonably possible and any mandatory cancellation rights remain unaffected.

19. Promotions and Discount Codes

Promotional codes, discounts, gifts or other ofers may be subject to additional conditions communicated with the relevant promotion.

Unless expressly stated otherwise, promotional codes:

  • cannot be exchanged for cash;
  • cannot be applied retrospectively;
  • may not be combined with other ofers;
  • may have an expiry date;
  • may be restricted to particular products, customers or territories.

Mandatory rules concerning price reductions and promotional pricing remain applicable.

20. Intellectual Property

The Website, CELESTO name, trademarks, logos, graphics, artwork, photographs, videos, designs, texts, product designs, prints, patterns, packaging, creative concepts and other content may be protected by copyright, trademark, design and other intellectual-property rights.

Such rights may belong to See More B.V., Celesto B.V., Celesto International B.V. or their respective licensors or creative partners, as applicable.

Certain CELESTO intellectual-property rights are owned by See More B.V. and licensed for use within the Celesto group.

Nothing on the Website grants you any license or right to commercially reproduce, distribute, modify, exploit or use protected material without prior written permission.

Personal, non-commercial use of the Website does not transfer any intellectual-property rights to you.

21. Website Use

You may not use the Website:

  • unlawfully or fraudulently;
  • to interfere with its security or operation;
  • to introduce malicious software;
  • to scrape, copy or commercially exploit content without permission;
  • to impersonate another person;
  • to infringe intellectual-property or privacy rights.

We may restrict access where reasonably necessary to protect the Website, customers or Celesto.

22. Third-Party Services and Links

The Website may contain functionality or links provided by third parties.

Celesto is not responsible for the content or availability of independent third-party websites or services except where responsibility cannot legally be excluded.

Use of third-party services may also be subject to their own terms and privacy notices.

23. Liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful.

Celesto is not liable for losses that are not reasonably foreseeable consequences of our breach or negligence.

Where products are purchased primarily for personal consumer use, we are not responsible for business losses such as loss of profit, business opportunity or revenue, except where mandatory law provides otherwise.

24. Force Majeure

Celesto is not responsible for a failure or delay caused by circumstances outside our reasonable control.

Such circumstances may include natural disasters, extreme weather, war, terrorism, civil unrest, epidemics, strikes, transport disruption, customs intervention, governmental measures, network outages or failures of suppliers or carriers beyond our reasonable control.

Mandatory consumer rights remain unaffected.

25. Changes to these Terms

These terms may be revised periodically to reflect changes to our business, website, services, or legal requirements.

The Terms applicable to your purchase are generally those made available when your order was placed, unless a later change must legally apply.

The latest version will always be published on the Website together with its revision date.

26. Governing Law

These Terms are governed by Dutch law.

If you are a consumer residing in another country, this choice of law does not deprive you of mandatory consumer protections that apply to you under the law of your country of residence.

Disputes may be brought before the competent courts in accordance with applicable law.
